This Policy
This Acceptable Use Policy (the “Policy”) sets out the rules governing the use of the Platform and our web services available via https://portal.thegapportal.com and/or https://app.thegaphq.com (together the “Services”) and any content that you may input, upload, record, or submit to the Services or transmit via the Services (“User Content”).
This Policy’s defined terms have the same meaning as in our Terms of Service, which should be read together with this Acceptable Use Policy.
By using the Service, you agree to the rules set out in this Policy.
General use:
Our Service is designed to facilitate the marketing, selling and delivery business advisory services. You agree to use the Platform and its features solely for their intended purpose and in a manner consistent with applicable laws and the intended functionality of the service.
Excessive use
You must not use the Services in a way that disrupts its performance or the experience of other users. We may monitor usage patterns to ensure compliance with these terms. Excessive use or misuse of any feature, including excessive document creation, meeting recordings, meeting summaries or use of the Service for activities outside the scope of business advisory services, may result in limitations or suspension of access to the Service or specific tools. We reserve the right to impose additional fees for unreasonable or excessive use.
You must not:
- Attempt to undermine the security or integrity of The Gap’s computing systems or networks, or where the Services are hosted by a third party, that third party’s computing systems and networks;
- Use, or misuse, the Services in any way which may impair the functionality of the Services or The Platform, or other systems used to deliver the Services or impair the ability of any other user to use the Services;
- Attempt to gain unauthorised access to any materials other than those to which you have been given express permission to access or to the computer system on which the Services are hosted;
- Attempt to modify, copy, adapt, reproduce, disassemble, decompile or reverse engineer any part of the Services or to operate the Services except as is strictly necessary to use it for normal operation;
- Use the Services in any way that is unlawful, illegal, fraudulent or harmful; or
- Use the Services in connection with any unlawful, illegal, fraudulent or harmful purpose or activity.
Licence
You grant to us a worldwide, irrevocable, non-exclusive, royalty-free licence to publish, and distribute your User Content solely for the purpose of operating, providing, and improving the Service.
Unlawful and illegal material
You must not use the Services to store, host, transmit or send User Content that is illegal or unlawful, or that will or may infringe a third party's legal rights, or that could give rise to legal action whether against you or us or a third party (in each case in any jurisdiction and under any applicable law).
User Content
User Content (and its use on the Service) must not:
- be libellous or maliciously false;
- be obscene or indecent;
- infringe any copyright, moral rights, database rights, trademark rights, design rights, rights in passing off, or other intellectual property rights;
- infringe any rights of confidence, rights of privacy, or rights under data protection legislation;
- constitute negligent advice or contain any negligent statement;
- constitute an incitement to commit a crime;
- be in contempt of any court, or in breach of any court order;
- be in breach of racial or religious hatred or discrimination legislation;
- be blasphemous;
- be in breach of official secrets legislation; or
- be in breach of any contractual obligation owed to any person.
- You must not submit any User Content that is or has ever been the subject of any threatened or actual legal proceedings or other similar complaint.
Prohibited use of sensitive personal information
You must not input, submit, or record (in writing or verbally), sensitive personal information into the Platform, including but not limited to the following: personal data of children, health information, financial account details (such as bank account numbers, credit or debit card numbers, security codes, online banking credentials, tax identification numbers, or other personally identifiable financial information), or any other information considered sensitive under applicable privacy laws. By using the Services, including the AI notetaker tool, you agree not to introduce any such information.
Data mining
You must not conduct any systematic or automated data collection activities (including without limitation scraping, data mining, data extraction and data harvesting) on or in relation to the Service.
Harmful software
You must not use the Service to promote or distribute any viruses, Trojans, worms, root kits, spyware, adware or any other harmful software, programs, routines, applications or technologies.
You must not use the Service to promote or distribute any software, programs, routines, applications or technologies that will or may negatively affect the performance of a computer or introduce significant security risks to a computer.
Marketing and spam
User Content must not constitute spam.
You must not use the Service to transmit or send unsolicited commercial communications.
You must not use the Service to market, distribute or post chain letters, ponzi schemes, pyramid schemes, matrix programs, "get rich quick" schemes or similar schemes, programs or materials..
Gambling
You must not use the Service for any purpose related to gambling, gaming, betting, lotteries, sweepstakes, prize competitions or any gambling-related activity.
Hyperlinks
You must not link to any website or web page containing material that would, were it posted on the Service, breach the preceding terms of this Policy.
Breaches of this Policy
We reserve the right to edit or remove any User Content in our sole discretion for any reason, without notice or explanation.
Without prejudice to this general right and our other legal rights, if you breach this Policy in any way, or if we reasonably suspect that you have breached this Policy in any way, we may:
- delete or edit any of your User Content;
- send you one or more formal warnings;
- temporarily suspend your access to a part or all of the Service; and/or
- permanently prohibit you from using a part or all of the Service.
Banned users
Where we suspend or prohibit your access to the Service or a part of the Service, you must not take any action to circumvent such suspension or prohibition (including without limitation using a different account).
Monitoring
Notwithstanding the provisions of this Policy, we do not actively monitor User Content.
Report abuse
If you become aware of any material on the Service that contravenes this Policy, you must notify us by email.
